Georgia THCA Law as of October 2026
Georgia’s hemp rules come from the Georgia Hemp Farming Act and Senate Bill 494. Governor Brian Kemp signed SB 494 in spring 2024. Its main rules took effect October 1, 2024.
Total THC Counts THCA
SB 494 measures hemp by total delta-9 THC after decarboxylation. The formula is delta-9 THC + (0.877 × THCA). The limit is 0.3% by dry weight.
Under that formula, most THCA flower is well over the limit.
No Retail Sale of Loose Hemp Flower
The Georgia Department of Agriculture says state law bars retail sale of loose hemp flower or leaves, whatever their THC level.
The department has treated pre-rolls differently. In a 2025 ruling, it said licensed retailers may sell pre-rolls under 0.3% total delta-9 THC, counting THCA, that meet testing and labeling rules.

SB 494 bars sales of consumable hemp products to anyone under 21. Retailers must hold a state hemp license.
