Is THCA Legal in North Carolina? October 2026

Quick answer: Yes, as of October 2026. North Carolina still defines hemp by delta-9 THC only, so compliant THCA flower is legal under state law. A pending bill, HB 328, would change that, and federal law will count THCA from December 11, 2026.

North Carolina has not yet passed its own hemp rules. That may change soon. Here is where things stand as of October 2026.

North Carolina THCA Key Dates

  • 2022: North Carolina permanently excludes hemp from its Controlled Substances Act.
  • July 2, 2026: The Senate approves the HB 328 conference report, 37-6.
  • Fall 2026: HB 328 awaits a House vote.
  • December 11, 2026: Federal total-THC rule takes effect.

North Carolina THCA Law as of October 2026

North Carolina’s Controlled Substances Act excludes hemp. It uses the federal standard: no more than 0.3% delta-9 THC by dry weight.

The state has no total-THC test, no per-package caps, and no hemp retail license. THCA flower that tests at or under 0.3% delta-9 THC is hemp under state law.

Age Limit in North Carolina

As of October 2026, North Carolina has no statewide minimum age for hemp products. Many stores, including HIGH THCA, sell only to adults 21 and over.

Pending Changes: HB 328

House Bill 328 would regulate hemp products in North Carolina. On July 2, 2026, the Senate approved a conference report on the bill, 37-6.

The House has not voted on it as of October 2026. Reports say the vote may wait until after the November 2026 election.

If it becomes law, HB 328 would:

  • Set a minimum age of 21 for hemp products.
  • Use a total-THC limit of 0.3% instead of delta-9 only.
  • Match the federal 0.4 mg per-container cap.
  • Keep the federal standard as state law, even if Congress later changes it.

A conference report cannot be amended. It needs a simple majority in the House, then goes to Governor Josh Stein.

Federal Change

Even without HB 328, federal law changes on December 11, 2026. From that date, federal law counts THCA toward the 0.3% limit in every state.

What This Means for Buying THCA Flower Online

As of October 2026, North Carolina adults can legally buy THCA flower that meets the 0.3% delta-9 THC standard.

Check the COA for each product. It should show delta-9 THC at or under 0.3% by dry weight.

Watch for news on HB 328 and the December 11, 2026 federal date. Either could change what is legal.

How to Check a COA for North Carolina

A Certificate of Analysis (COA) is the lab report for a product batch. It shows how much of each cannabinoid is in the product.

North Carolina uses the delta-9 standard today, so the delta-9 THC line is the key number for now.

  • Delta-9 THC: the percentage of delta-9 THC by dry weight.
  • THCA: the percentage of THCA.
  • Total THC: usually delta-9 THC + (0.877 × THCA).
  • Batch number: should match the product you buy.

Every HIGH THCA product is lab tested and has a COA. See them on our Certificate of Analysis page.
