Tennessee THCA Law as of October 2026
In 2025, the Legislature passed House Bill 1376, now Public Chapter 526. It changed how Tennessee measures and regulates hemp products.
Step One: January 1, 2026
- The Tennessee Alcoholic Beverage Commission (TABC) took over hemp regulation from the Department of Agriculture.
- Only licensed retailers may sell hemp products.
- Online hemp sales are prohibited.
Step Two: July 1, 2026
The THCA ban was first set for January 1, 2026. A late deal between lawmakers and industry let businesses under the old licenses keep selling THCA through June 30, 2026.
TABC finalized its rules in May 2026. Since July 1, 2026, THCA products with 0.3% or more cannot be sold or shipped in Tennessee.

Only adults 21 and older may buy hemp products in Tennessee. Sales must happen at licensed, age-checked locations.
Pending Changes
