Quick answer: As of October 2026, Texas rules count THCA toward the 0.3% THC limit, so most THCA flower can no longer be sold as hemp in Texas. Those rules took effect March 31, 2026, and court challenges are still open. Buyers must be 21 or older.

Texas has changed its hemp rules several times since 2025. This guide explains where THCA stands in Texas as of October 2026.

Texas THCA Key Dates

  • 2019: Texas legalizes hemp at 0.3% delta-9 THC.
  • June 2025: Governor Abbott vetoes SB 3.
  • September 10, 2025: Executive Order GA-56 is signed.
  • Fall 2025: 21+ age rules take effect.
  • March 31, 2026: DSHS total-THC rules take effect.
  • June 2026: Appeals court lets the rules take effect again.
  • July 31, 2026: DSHS scheduling of non-delta-9 THCs takes effect.
  • December 11, 2026: Federal total-THC rule takes effect.

Texas THCA Law as of October 2026

Texas legalized hemp in 2019. That law used the federal standard: no more than 0.3% delta-9 THC by dry weight. It did not count THCA.

In 2025, the Legislature passed SB 3, which would have banned most THC hemp products. Governor Greg Abbott vetoed it in June 2025.

On September 10, 2025, the governor signed Executive Order GA-56. It told state agencies to tighten hemp rules, including a minimum age of 21.

The DSHS Total-THC Rule

The Texas Department of State Health Services (DSHS) adopted new consumable hemp rules. They took effect March 31, 2026.

The rules add THCA to the definition of total delta-9 THC. The formula is delta-9 THC + (0.877 × THCA). Most THCA flower fails that test.

The rules also raised license fees to $5,000 per retail location and $10,000 per manufacturing facility.

Court Challenges

  • April 2026: A Travis County judge paused the DSHS rules.
  • June 2026: The Fifteenth Court of Appeals let the rules take effect again while the case continues.
  • July 31, 2026: DSHS’s 2021 controlled-substance definitions took effect. They schedule delta-8 and other non-delta-9 THCs.
  • July and August 2026: New lawsuits were filed in federal court and in Travis County.

As of mid-September 2026, local news reported that enforcement of THCA flower possession varied by city and county. The main appeal had no decision date.

Age Limit in Texas

You must be 21 or older to buy consumable hemp products in Texas. The age rule came from GA-56 and agency rules in fall 2025. Sellers must check a government photo ID.

Pending Changes

Two things could change the picture soon:

  • Texas courts: The Fifteenth Court of Appeals has not ruled on the merits of the DSHS rules.
  • Federal law: On December 11, 2026, federal law will count THCA toward the 0.3% limit in every state.

Even if Texas courts strike the DSHS rules, the federal change still applies after December 11, 2026.

What This Means for Buying THCA Flower Online

Texas rules now judge hemp by total THC, not delta-9 alone. Most THCA flower does not pass that test.

Products that stay at or under 0.3% total THC, such as compliant delta-9 or CBD products, are not affected by the THCA rule.

Always check a product’s COA. It should show delta-9 THC, THCA, and total THC for the batch.

How to Check a COA for Texas

A Certificate of Analysis (COA) is the lab report for a product batch. It shows how much of each cannabinoid is in the product.

Texas now uses a total-THC number, so the THCA line on a COA matters as much as the delta-9 line.

  • Delta-9 THC: the percentage of delta-9 THC by dry weight.
  • THCA: the percentage of THCA.
  • Total THC: usually delta-9 THC + (0.877 × THCA).
  • Batch number: should match the product you buy.

Every HIGH THCA product is lab tested and has a COA. See them on our Certificate of Analysis page.
